PAYMENT AUTHORIZATION
For purposes of this payment authorization, the term "I" refers to  the  person whose name appears  above as the  primary account holder and whose signature appears below, "You" refers to the financial institution I have identified.
I authorize you to pay JSB Fitness LLC charges/fees on my behalf to Club Owner (or its designee) in the amount of AED	,begining from		_ These payments will continue until I submit a written notice of cancellation of my membership payment terms and
pay any account balance due upon cancellation. I understand that I may continue to be billed as per the cancellation policy set within this agreement after cancellation request. I agree that you will be fully protected in honoring these charges/fees and that your treatment of them and
rights in respect to them are the same as if personally signed by me. I understand that I must notify the Club of account changes at least
five days before my next billing cycle, and that I will incur an additional fee of AED l 00.00 whenever my payment declines.

MEMBERSHIP TERMS AND CONDITIONS
DEFINITIONS. In this Agreement:
l.  "Applicant" means a  person whose  name is stated in the  application  form and  is of  18 years in age  or above. As an  exception, a person who is at  least 14 years of age  and  has a signed consent from his parents may be considered as an Applicant at the sole discretion of the Snap Fitness Club;
2.	"Club Owner" means JSB Fitness LLC, an independent franchisee.
3.	"Club" means Snap Fitness SFMedia City.
4.	"I" and "Member" means the person(s) whose name(s) and signature(s) and initials appear on this document. Member is responsible for updating address and contact information;
5.	"Company" means JSB Fitness LLC.
6.	"Fee and  Charges" mean all membership fee, administrative charges, access charges, physical training charges,
as may be notified by the Club from time to  time, and  shall exclude all kind of  taxes and  levies, including VAT, etc., as may be levied by the regulatory authorities from time to time.
7.	"Licensor" means the brand owner.
8.	"Member" means an Applicant who, based on the representation and warranties given by him, has been admitted to a Membership Plan of the Club
9.	"Membership Plan" means the membership that has been selected  by the  Applicant in the Application Form while making an application for being admitted as a Member
l0. "Club Location" means Snap Fitness Club located at the venue stated in the application form
ll. "VAT"means Value Added Tax levied/to be levied by the regulatory authorities in United Arab Emirates at such rates as may be applicable from time to time.

MEMBERSHIP OF THE SNAP FITNESS CLUB.

l. I confirm that I have applied for and have been accepted as a Member of the Club based on my representations and warranties made and indemnities given by me in this Application Form and these Terms and Conditions.
2. The Club has been setup and is operated by the Company for providing health and fitness services to its Members and their Guests.

MEMBER OBLIGATIONS. This Agreement is a legally binding obligation for which I am financially responsible. All membership plans are non refundable.
A monthly auto debit payment membership if cancelled within 6 months from the start date is subject to a cencellation fee of AED 99.
Member agrees not to conduct any kind of commercial or business  activity in the Club and  shall not  act as a  personal  trainer  for anyone within  the Club & engage with any external personal trainers within the club

CANCELLATION.
l.  All monthly membership cancellation requests will be subject to notice requirements  as per below clauses:-
1.l Cancellation request received from the l st to the 14th of a month will not be considered for charge in the next month auto debit cycle. The Membership will end automatically at the end of the month.
1.2	Cancellation request received from the 15th to the end of a month will be considered for full in charge to the next months auto debit cycle. The Membership will end automatically at the end of the next month.
1.3	All cancellation requests irrespective of the date of submission are subject to the cancellation fee of AED 99/-, within 6 months of the membership start date.
RECIPROCITY AND TRANSFER. Membership to the Club allows me to access other Snap Fitness® locations free of charge. My use of all Snap Fitness® locations is subject to the terms of this Agreement and I have the same obligations to any Snap Fitness® location as I have to the Club and Club Owner: including the assumption  of risk and waiver of claims. If my  membership is transferred, I agree my monthly dues will be  the  price of the  new  home club and I may have to sign a new membership agreement with that club.

MEMBERSHIP FREEZE. I have the right to freeze my 12 month Lumpsum membership plan for up to one month per year without any charges.
I may freeze my 12 month Lumpsum plan for a maximum of two additional months with a  freezing fee  of  AED  l 00 per  month. All other membership  types may freeze for a maximum of two months with a freezing fee of AED l 00 per month. In order to freeze my membership, I must provide written notice by the 25th of the month before the month for which the freeze is to take effect. A membership cannot be canceled during a freeze period.

FEES AND CHARGES.
l. I hereby authorize the  Snap Fitness  Club to debit my credit or debit card for  the  total amount due  on my Membership.  I hereby authorize the  Snap Fitness  Club to use any other form of recovery should my account fall into arrears.
2.	I agree that if my account falls into arrears, I must clear all the outstanding amounts immediately  If  the  account remains in arrears past  the  14th of  a  month, the Snap Fitness Club is authorized to levy an additional administration charge of no less than AED 100 (per month outstanding) to my account.
3.	While in arrears my account will be suspended, I may be  debarred from access  and  use of my membership privileges until such time that the arrears  and any further outstanding charges are cleared.
4.	I agree that the Snap Fitness Club shall have the right to cancel any membership on which fees are unpaid, and that in such an event, Legal action may be taken to recover any outstanding dues from me at my cost and expense.
5.	Membership fees may be increased by the Snap Fitness Club from time to time by giving a one month notice on or after the anniversary date of my Membership. For upfront memberships this increase may be greater and applied upon the renewal of the membership.
6.	Additional administrative charges may be levied by the Club from time to time for administrative services like transfer of a Membership, downgrading, upgrading, etc., and that I will be required to pay for any lost or damaged locker keys, replacement of membership cards.
7.	I confirm and agree that the Club reserves the right to increase the Fee and  Charges from time to time at its sole discretion.
TERMINATION BY THE CLUB.
l.  My  Membership may be terminated by the Club without notice if in the Club's reasonable opinion, continued membership is likely to be injurious to the character
and interests of any particular club, member; staff or the Member itself e.g., abusive or threatening behavior, vandalism, violation of the privacy of any other member, employee or guest. illegal activity and any occurrence where continuation of membership maybe harmful to the health or wellbeing of themselves or any other individual or individuals.
2.	My Membership may be terminated with immediate effect if i) I have breached any terms and conditions of this contract; or ii) membership fees or other charges remain unpaid including dues and personal training; or if my Club permanently ceases operation and there is no reasonable alternative.
3.	The parties acknowledge and agree that a court order will not be required to give effect to any termination of this Agreement.
FACILITIES AND SERVICES.
The Club reserves the right at any time to delete. discontinue. repair or replace the facility equipment without any effect on this Agreement. The Club may be closed for up to two weeks each year for maintenance purposes.
I understand that,
l. the club and use of its facilities are for exclusive benefit of paying members. their authorized guests as well as contractors and guests of the Management.
2.	The Club Owners reserve the right to close Clubs, or parts of the Clubs from time to time at the management's discretion, e.g. Maintenance, repairs, refurbishment and emergencies.
 
3.	The Club Owners may on occasion close a club totally where an alternative club membership will be offered, you would be informed ahead of time if such an action was to be undertaken.
4.	Services and facilities provided by the club may change at management discretion.
5.	Opening hours are subject to change but this will be communicated to members.
6.	My membership does not include Personal Training and/ or any other additional paid for activity
7.	I am not allowed to use any of Club facilities whilst suffering from infection or contagious illness that could affect others in the Club.

NO STEROIDS. I understand that the Club bans the use of steroids and I agree not to use, sell or exchange steroids on the Club's premises.
LIMITATION OF LIABILITY. I agree that neither me nor the any other party named in this Agreement shall be  liable for any indirect, special, consequential or other damages, loss of profits, turnover, etc. to the other Party.
MISCELLANEOUS.
I agree that,
l. The use of mobile phones with camera features and/or any other types of visual recorders in changing rooms are strictly prohibited, and that members breaching this rule will be handed over to the authorities to be dealt with accordingly.
2.	The Club's failure to  enforce any of its rights at  any  time, for any  period and  for whatever reason will not  be  construed as a  waiver  of such rights by  the  Club, neither will any failure to identify or act upon my breach of the terms of this contract be deemed to be an affirmation by the Club that my behavior is acceptable.
3.	Soliciting and/or selling private Personal Training, Swimming, Coaching of any sort, merchandising of any type to any member are prohibited and shall result in immediate termination of the member concerned.
4.	All members must abide by the rules of the Club which may be amended, varied, deleted and added to from time to time at the Club's Discretion. Only authorized members or guests may access the Club and I am not permitted to share my access card with anyone else.
5.	Members are not permitted to utilize the services of any external/unauthorised services such as, non Snap Fitness Personal Trainers, Sports Coaches or Teachers on the premises.
6.	Members and/or guests are not allowed to photograph or copy any Club interior designs, promotional materials, tag lines, themes or concepts.
The Club reserves the right to proceed with legal action to any member caught distributing, sharing or supplying such contents to any third party vendor or competitor.
7.	Where a provision of this Agreement is deemed to be invalid or unenforceable by any UAE Court, the provision will be deleted but such deletion will not affect the validity and enforceability of the remaining provisions.
8.	The Owners may assign or transfer the benefit of this Agreement or sub-contract their obligations under it, to any other legal entity at any time without notice to me.
9.	Written notices that are required to be given by either party may be sent using email to the address provided by me. l 0. My contact details maybe used for selected marketing communications from the Club and its selected partners.
l l. Except where permitted by this Agreement, neither party may alter the terms and conditions without the written agreement from the other party and no written or oral representation by either party will serve to modify or amend these terms and conditions in any way.
12.	This is the whole Agreement between the parties with respect to the Membership Terms and Conditions and supersedes any prior understandings or agreements whether written or oral, express or implied. This Agreement may not be amended or modified except in a writing signed by both parties.
13.	This Agreement shall be subject to UAE Laws as applicable to the Emirate of Dubai, and shall be subject to jurisdiction of Courts at Dubai, UAE.
14.	Member is responsible for updating address and  contact information.
